Privacy Policy
1. Introduction
Recuptive ("we," "us," or "our") is an AI-assisted lead recovery service operated by Mailein Caceres. This Privacy Policy explains what information we collect, how we use it, who we share it with, and what rights you have.
This Policy applies to two distinct groups:
- Clients — businesses (such as HVAC, roofing, plumbing, electrical, cleaning, and similar home service companies) that use Recuptive's services.
- Leads — individuals whose contact information is submitted to Recuptive by a Client in connection with the Client's use of our service.
2. Information We Collect
2A. Information Clients Provide
When you use Recuptive as a Client, we may collect:
- Your name, business name, email address, and phone number
- Business configuration details (lead sources, team contacts, message sequences)
- Payment and billing information (processed by our payment processor; Recuptive does not store raw card data)
- Communications you have with us (emails, support messages)
2B. Information About Leads
Recuptive processes personal information about Leads on behalf of Clients. This information is provided to us by Clients and may include:
- First and last name
- Email address
- Phone number
- The source URL where the lead originated
- Timestamps of lead submission and contact attempts
- Records of messages sent and response status
- Opt-out and suppression status
Recuptive acts as a service provider for this Lead data. The Client is the responsible party for Lead data and is responsible for ensuring they have a lawful basis to share that data with Recuptive and to authorize automated follow-up communications on their behalf.
2C. Information Collected Automatically
When you visit recuptive.com, our servers may log limited technical information, including:
- IP address
- Browser type and version
- Pages visited and time of visit
- Referring URL
We do not use cookies for tracking or advertising purposes. We do not use third-party analytics tools at this time. Server logs are used solely for security, fraud prevention, and operational purposes, and are retained according to the standard practices of our infrastructure providers.
3. How We Use Information
3A. Client Information
We use Client information to:
- Provide, operate, and improve the Recuptive service
- Configure automated follow-up sequences on the Client's behalf
- Communicate with Clients about their account and support needs
- Process billing and prevent fraud
- Comply with legal obligations
3B. Lead Information
We use Lead information solely to:
- Send automated follow-up messages (email and SMS) on behalf of the Client, using the contact details and sequences the Client has configured
- Record contact attempt history and delivery status
- Process opt-out and unsubscribe requests
- Maintain suppression lists to honor opt-outs and prevent re-contact
We do not use Lead information for our own marketing purposes. We do not sell Lead information.
4. How We Share Information
We do not sell, rent, or trade personal information to third parties.
To operate the service, Recuptive uses infrastructure, hosting, database, security, messaging, and other service providers as reasonably necessary. These providers may process personal information in connection with the services they provide to us. We require that such providers use personal information only as necessary to perform their services.
Our current messaging providers, who handle data transmitted through their platforms in accordance with their own terms and privacy policies, are:

We may engage additional service providers as the service evolves. This Policy will be updated when we do. We may also disclose information if required by law, court order, or to protect the rights, property, or safety of Recuptive, our Clients, or others.
5. Automated Messaging and Your Rights as a Lead
If you have received a message through Recuptive on behalf of a business, that business is our Client. Clients are responsible for ensuring they have a lawful basis to contact you and for complying with all applicable laws governing electronic marketing communications, including the TCPA and CAN-SPAM Act.
To stop receiving messages:
- Email: Click the unsubscribe link included at the bottom of every email sent on a Client's behalf.
- SMS: Reply STOP to any text message to opt out of SMS from that Client.
- Email us: Contact legal@recuptive.com and we will process your request promptly.
Opt-out requests are processed immediately. Your contact information is then added to a suppression list to prevent further contact through Recuptive by that Client. Suppression records are retained to ensure your opt-out continues to be honored — we do not delete opt-out records, because doing so could allow accidental re-contact.
6. Data Retention
Client data is retained for as long as necessary to provide the Recuptive service and for a reasonable period thereafter to support billing, security, fraud prevention, and legal compliance. Upon a Client's written request for account deletion, we will delete or anonymize Client data, subject to any data we are required to retain for legal or compliance reasons.
Lead data is retained for as long as the associated Client account is active and for a reasonable period thereafter. Clients may request deletion of Lead data associated with their account at any time by contacting legal@recuptive.com.
Opt-out and suppression records are retained indefinitely to honor opt-out requests and prevent re-contact.
Server and infrastructure logs are retained according to the standard practices of our underlying infrastructure providers. Recuptive does not maintain a separate log deletion schedule beyond what those providers apply.
7. Data Security
We take reasonable steps to protect personal information from unauthorized access, disclosure, or loss. Measures in place include:
- Encrypted data transmission (HTTPS/TLS) for all communications
- API key-based access controls for administrative functions
- Cryptographically signed tokens for user-facing operations such as unsubscribe links
- Separation of public-facing and internal data access paths
No method of electronic transmission or storage is completely secure. We will notify affected parties and relevant authorities as required by applicable law in the event of a data breach.
8. Children's Privacy
Recuptive's services are not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected such information, contact us at legal@recuptive.com and we will delete it promptly.
9. Privacy Rights
Regardless of where you are located, you may contact us at legal@recuptive.com to:
- Request access to personal information we hold about you
- Request correction of inaccurate information
- Request deletion of your information, subject to retention obligations described in Section 6
- Opt out of marketing communications
We will respond to verifiable requests promptly and in good faith. Response times may vary depending on the nature and volume of requests.
California residents may have additional rights under California law. If you are a California resident and believe those rights apply to your situation, please contact us at legal@recuptive.com and we will assess your request under applicable law.
10. CAN-SPAM and TCPA
All commercial email sent through Recuptive includes:
- Clear identification of the sending business
- A functional unsubscribe mechanism
- A physical mailing address as required by the CAN-SPAM Act
SMS messages sent through Recuptive are initiated by Clients who are responsible for ensuring recipient consent meets applicable TCPA requirements. Recipients may opt out at any time by replying STOP.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated policy at recuptive.com/privacy with an updated effective date. When changes are material, we will provide additional notice as required by applicable law or as we determine is reasonably appropriate given the nature of the change, which may include direct notice to active Clients.
